1. Acceptance of Terms

Welcome to TubeGrasp! These Terms of Service (“Terms”) govern your use of TubeGrasp (the “Service”), a platform that converts YouTube videos into searchable knowledge bases using AI technology. The Service is operated by Mlola (“we,” “us,” or “our”), a company founded by Fikri Firdaus and based in Sidoarjo, East Java, Indonesia.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

TubeGrasp provides the following services:

  • Processing user-provided transcripts and YouTube video metadata
  • Generating AI-powered insights and summaries from transcript content
  • Creating searchable embeddings for semantic content search
  • Providing intelligent question-answering capabilities
  • Organizing video content into knowledge bases

3. Third-Party Dependencies and Service Limitations

External Service Dependencies: Our Service utilizes various third-party AI platforms and may access YouTube video metadata to deliver its functionality. By using our Service, you acknowledge and agree that:

  • Third-party platforms may modify their access policies, technical specifications, or terms of service at their discretion
  • External AI services may implement usage limitations, geographic restrictions, or operational changes
  • Video metadata accessibility depends on the originating platform's policies and technical infrastructure
  • Videos with privacy restrictions or platform-specific limitations may have limited metadata availability
  • Service availability is subject to the operational status and policies of external providers

User-Provided Content Requirements: Our Service requires users to provide their own transcripts for video processing. You acknowledge that:

  • Transcript quality and accuracy directly affect the quality of AI analysis and insights
  • You are responsible for ensuring transcript accuracy and completeness
  • Processing results depend on the quality and format of user-provided transcripts
  • We do not verify or guarantee the accuracy of user-provided transcripts

Limitation of Liability for External Factors: We shall not be held responsible or liable for:

  • Service disruptions resulting from changes in third-party platform policies or infrastructure
  • Processing limitations due to external service modifications or restrictions
  • Analysis quality issues arising from inaccurate or incomplete user-provided transcripts
  • Technical failures caused by external service interruptions or policy changes
  • Any direct or indirect consequences resulting from external service dependencies or user-provided content quality

Credit and Refund Policy for External Issues: Credits will not be refunded for service limitations or processing failures caused by:

  • Third-party platform policy changes or access modifications
  • External service operational decisions or technical limitations
  • Poor quality, incomplete, or inaccurate user-provided transcripts
  • Network infrastructure issues or connectivity disruptions
  • Any circumstances beyond our reasonable control or influence

User Agreement and Risk Acceptance: By purchasing credits and utilizing our Service, you explicitly acknowledge these external dependencies and their inherent limitations. You understand that service functionality may be affected by third-party decisions, technical factors, and the quality of user-provided content, and agree to accept such risks without seeking compensation, refunds, or damages for issues arising from external service dependencies or transcript quality.

4. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

5. Credit System and Billing

Our Service operates on a credit-based system:

  • Video Processing: Each video processed consumes 1 credit
  • AI Searches: Each AI search/question consumes 0.05 credits
  • Processing Failures: Video processing may fail due to technical issues, unavailable videos, missing captions, or other factors. You can retry processing using the "Retry Processing" button in your dashboard
  • Failed Processing Refunds: Credits are automatically refunded only for failed processing attempts
  • Credit Expiration: Credits do not expire as long as the platform is live and running
  • Payment: All credit purchases are processed through secure payment providers
  • Credit Refund Policy: Purchased credits cannot be refunded except within 14 days of purchase and subject to the refund policy outlined below

6. Refund Policy

14-Day Refund Window: If you are a Consumer, you have the right to cancel your credit purchase and request a refund within 14 days of purchase. The cancellation period will expire after 14 days from the day of the transaction completion.

Partial Refund Based on Usage: Refunds will be calculated based on the portion of credits already consumed. If you have used credits for video processing or AI searches, the refund amount will be reduced proportionally. For example, if you purchased 100 credits and used 30 credits, you may be eligible for a refund of the remaining 70 credits only.

Refund Process: To request a refund, you must inform us of your decision within the 14-day period. To ensure immediate processing, please contact us here with your transaction details and reason for refund.

Automatic Processing Refunds: Credits are automatically refunded only when video processing fails due to technical issues. This is separate from the 14-day purchase refund policy.

7. Acceptable Use Policy

You agree not to use the Service to:

  • Process copyrighted content without proper authorization
  • Upload malicious, harmful, or inappropriate content
  • Attempt to reverse engineer or compromise the Service
  • Use the Service for illegal activities
  • Abuse or overload our systems
  • Share account credentials with others

8. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Mlola and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service, but grant us a license to process, store, and analyze such content to provide the Service.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection, use, and disclosure of your personal information.

10. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Update these Terms as necessary
  • Refuse service to anyone for any reason
  • Set usage limits and restrictions

Service Discontinuation: We may stop, suspend, or permanently discontinue the Service at any time, for any reason, with or without notice. This includes but is not limited to technical issues, business decisions, server changes, infrastructure modifications, or any other circumstances we deem necessary.

No Compensation for Service Changes: In the event of service modification, suspension, or discontinuation, users are not entitled to:

  • Refunds of unused credits
  • Compensation for lost data or access
  • Restoration of previous service levels
  • Migration to alternative services
  • Any form of damages or reimbursement

User Acknowledgment: By using our Service, you acknowledge and accept that the Service may be interrupted, modified, or discontinued at any time, and that your credits and data may become inaccessible without compensation.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by law, Mlola shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law principles.
